The water is fully in all our ditches.

 

The ditch companies have fulfilled their responsibility by keeping water in the main canals to the best of their ability.

For those on PRIVATE LATERALS, once the water leaves the main ditch, it becomes the responsibility of the water users on any private laterals to get their water to their property. 
Middleton Irrigation is the “parent” company.  Neither Middleton Irrigation nor its incorporated laterals (Canyon Hill, Lemp, Newman, Foothill Ditch, or Flake Ditch) clean, maintain or repair any private laterals.

If the private lateral is full of weeds and debris or has been filled in from lack of regular maintenance, repair and/or cleaning, that is also on the water users of the private lateral.

It is the water user’s responsibility to open any headgates to receive their water, if on a rotation, at their appointed time for their allotted time. 
The ditch companies do not make or keep track of rotations, that is between water users.

Whenever there are three or more users on a private lateral, those users are de facto a lateral association, under the state statute of Title 42, Chapter 13.   

Water is attached to the land.  Surface water is to be used before groundwater.  The assessments must be paid whether the landowner uses the water or not. 

Hopefully this information helps you to understand your responsibilities pertaining to your water rights.

If you live in a subdivision and do not have water, please contact your HOA or HOA Management Co. as they are the ones responsible to get the pumps turned on.

Additionally, this ditch company does not fix broken sprinkler lines.


Please off-set watering times, so not everybody is watering between 4-8 a.m.  It is perfectly okay to water in the middle of the day.

Offsetting the watering times REALLY helps the system stay consistent and creates a much more efficient water availability.  

Much damage is being caused by the ducks in the area.  One would not think that those light-weight, flat-footed fowl could do that much damage, but they are causing a lot of erosion of the ditch banks.  As more and more people have flooded into the valley, the issue has increased as more and more folks have taken to feeding the ducks -- which encourages the ducks to come to certain areas and their numbers are creating this issue.

Feeding ducks can be fun for adults and kids alike, but, we would ask that is practice not occur on the ditch banks.

If the HOA boards & HOA management companies could get the word out to their residences, that would be very helpful.

For those who like to post things on social media -- this would be one of those things that we would welcome you to post, because this issue is not exclusive to this ditch company, like our other notices are.

Annual Stockholders Meetings

Middleton Irrigation and Middleton Mill Ditch Co. Annual Stockholders Meetings are held on the first Saturday after the first Monday after the New Year at 10:30 a.m.
